Terms and Conditions
For any inquiries regarding the potential hire of our professional services or whether you have entered into a mutual agreement with us, please thoroughly review our comprehensive photography and videography terms and conditions detailed below. This ensures a smooth and transparent experience, allowing us to provide you with the highest quality service tailored to your needs.
Photography Terms and conditions
It is mutually agreed that the following terms and conditions of agreement form an integral part of this photography contract by and between Jan Theron Photography and the clients and that no modification of this contract will be accepted:
1. Booking and Payment
A non-refundable booking fee is required to secure the booking and the date will only be secured once this booking fee is paid. Payment of the outstanding balance is to be made one week prior to the wedding. Editing will not commence and no images will be delivered before the outstanding balance is paid. Payment for additional time and photographs as well as travel charges (if applicable) is to be made on the first working day after the wedding.
2. Cancellation Policy
In the event that the client cancels the contract for any reason whatsoever (other than death) the client agrees that Jan Theron Photography will retain the booking fee as a reasonable cancellation charge in respect to the cancellation. In the event that Jan Theron Photography is able to secure another booking for the same date as the cancelled wedding date, the booking fee paid by the cancelling party will be reimbursed, minus an administrative charge of R850.00 which will be retained by Jan Theron Photography.
3. Backup Photographers
In the event that the photographer cannot photograph the wedding due to unforeseen circumstances, Jan Theron Photography will call on the help of back up photographers. Their styles and approach will differ, but a professional code of conduct will be adhered to.
4. Client Requests
The photographer will endeavour to honour all requested photographs by the client, provided that the following factors are met: (a) weather permitting, (b) allocated time permitted (c) availability and co-operation of the person’s concerned and (d) appropriate lighting conditions. The photographer shall not be held responsible for photographs not taken by Jan Theron Photography due to (a) incorrect or misleading information regarding times and / or addresses supplied by the client, (b) any persons (including the bridal couple, bridal party, wedding guests, venue management & staff and other service providers to the bridal couple) being late or uncooperative, (c) any photographic restrictions at the place of the ceremony or (d) any visual obstruction caused by any décor, individuals or non-official photographers and videographers during the event.
5. Artistic License
The photographer is herewith granted artistic license with regards to poses, locations, composition, exposure, number of photographs taken, post production as well as all other creative and technical aspects of the photography during and after the assignment. The photographer’s decision regarding the abovementioned shall be deemed correct.
6. Editing
All basic editing during the post production stage is included in the photography package. The photographer’s decision regarding basic editing is final. All additional editing, over and above the basic editing, is being referred to as specialised editing and will be charged at R950.00 per hour, if required by the client.
7. Reception Coverage
For optimal creative and most effective photographic coverage of the wedding reception, the photographer and his assistant should be seated and receive their meals at a table from where the main table will be clearly visible. The photographer shall not be held responsible for reception photographs not taken by Jan Theron Photography due to lack of abovementioned seating arrangements. The photographer reserves the right to leave the reception if no seating is arranged. This clause only refers to those packages where reception coverage is requested.
8. Colour Balance
Photographs produced will provide a colour balance based on skin tones and white balance readings from the photographic equipment and the photographer & editor will use their skill in producing images of the highest possible quality and standard.
9. Portfolio Use
The client’s permission is granted to the photographer for the use of the photographs covered in this contract, for portfolios.
10. Travel and Accommodation
If the wedding is to take place more than 100 kilometres from Cape Town, the client agrees to pay R6 per km for travelling as well as overnight accommodation for the photographer and his assistant at an accredited hotel or guest house.
11. Courier Costs
Courier costs (if applicable) are excluded from the wedding photography package and will be handled on an ad hoc basis. The photographer cannot be held responsible for any damages or loss to wedding products sent via postal services or couriers.
12. Delivery Timeline
The client understands that while every attempt is made to provide the photographs of the wedding to the client as soon as possible, the client accepts that in some instances the editing process is lengthy and as such no guarantee is provided as to the exact date of delivery of the photographs. A “priority edit fee” can be arranged should the client require an “urgent” final product.
13. Liability Indemnity
The client indemnifies Jan Theron Photography from any liability for any loss, harm, injury, death or disability which may result directly or indirectly from an incident or accident which may occur during the photographic shoot. Should the clients elect to have their photographs taken in a dangerous area or location which may result in any loss, harm, injury, death or disability, they do so entirely at their own risk and having fully appraised themselves of such risks. Jan Theron Photography reserves the right to refuse any photographic coverage in any area or location with possible danger.
14. Data Loss Indemnity
The client indemnifies Jan Theron Photography from any liability for any loss of electronic data which may result either directly or indirectly from any incident or accident which may occur during or after the photographic shoot.
15. Archiving
It is clearly agreed upon by the parties that the archiving of photographic material in whatever form does not form part of this agreement. Jan Theron Photography will not be responsible to archive or retain any photographic material in whatever form and will also not be liable for any loss thereof after date of delivery.
16. Raw Photographic Material
Raw photographic material is never released to any client, under any circumstances, without exception. Raw material is professionally edited into a final product before it is released to the client.
17. Authorization
The client (if anyone other than the bride or groom), in signing this agreement, confirms that he / she is authorised to act on behalf of the bridal couple and binds them jointly for the due performance of all obligations in this agreement.
18. Acceptance of Terms
When securing Jan Theron Photography’s services the client declares that they accept the above terms and conditions. The client declares that they have seen examples of Jan Theron Photography’s work on this website and that they are satisfied with the style and approach thereof.
Videography Terms and conditions
It is mutually agreed that the following terms and conditions of agreement form an integral part of this videography contract by and between Teresa Theron Videography and the clients and that no modification of this contract will be accepted:

A “priority edit fee” can be arranged should the client require an “urgent” final product.

The client specifically indemnifies Teresa Theron Videography as well as their employees, agents & assistants from any and all liability for any and all loss, harm, injury, death or disability which may result either directly or indirectly from any incident or accident which may occur during any videographic shoot. Should the clients elect to have their video footage taken in a dangerous area or location which may result in any loss, harm, injury, death or disability, they do so entirely at their own risk and having fully appraised themselves of such risks. Teresa Theron Videography reserves the right to refuse any videographic coverage in any area or location with possible danger.

Raw videographic material is never released to any client, under any circumstances, without exception. Raw material is professionally edited into a final product before it is released to the client.
17. Music Submission
The client is allowed a period of up to 30 days after the wedding day to supply their preferred music to Teresa Theron Videography, to be used in the soundtrack of the final wedding video production. If no preferred music is received from the client 30 days after the wedding Teresa Theron Videography will make the final choice regarding suitable music for the video soundtrack.
18. Authorization
The client (if anyone other than the bride or groom), in signing this agreement, confirms that he / she is authorised to act on behalf of the bridal couple and binds them jointly for the due performance of all obligations in this agreement.
19. Acceptance of Terms
When securing Teresa Theron Videography’s services the client declares that they accept the above terms and conditions. The client declares that they have seen examples of Teresa Theron’s work on this website and that they are satisfied with the style and approach thereof.
